The Philippines, being ranked 4th<\/sup>\nin the world among countries with the longest coastline with a water area of\n1830 sq. km., implements a Clean Water Act to protect its water resources\nversus the rising population of the country.<\/p>\n\n\n\n

The law promotes quality management for all\nbodies of water.<\/p>\n\n\n\n

The Department of Environment and Natural\nResources (DENR) takes the lead in the implementation of the Clean Water Act\n(CWA).<\/p>\n\n\n\n

The Local Government Units, on the other\nhand, takes responsibility in the management and improvement of water quality\nin their jurisdiction.<\/p>\n\n\n\n

Based on the CWA, the following are the\nprohibited acts:<\/p>\n\n\n\n

a)<\/strong> Discharging, depositing\nor causing to be deposited material of any kind directly or indirectly into the\nwater bodies or along the margins of any surface water, where, the same shall be\nliable to be washed into such surface water, either by tide action or by storm,\nfloods or otherwise, which could cause water pollution or impede natural flow\nin the water body;<\/p>\n\n\n\n

b)<\/strong> Discharging, injecting\nor allowing to seep into the soil or sub-soil any substance in any form that\nwould pollute groundwater. In the case of geothermal projects, and subject to\nthe approval of the Department, regulated discharge for short- term activities\n(e.g. well testing, flushing, commissioning, venting) and deep re-injection of\ngeothermal liquids may be allowed: Provided, That safety measures are adopted\nto prevent the contamination of the groundwater;<\/p>\n\n\n\n

c)<\/strong> Operating facilities\nthat discharge regulated water pollutants without the valid required permits or\nafter the permit was revoked for any violation of any condition therein;<\/p>\n\n\n\n

d)<\/strong> Disposal of potentially\ninfectious medical waste into sea water by vessels unless the health or safety\nof individuals on board the vessel is threatened by a great and imminent peril;<\/p>\n\n\n\n

e)<\/strong> Unauthorized transport\nor dumping into sea waters of sewage sludge or solid waste as defined under\nRepublic Act No.9003;<\/p>\n\n\n\n

f)<\/strong> Transport, dumping or\ndischarge of prohibited chemicals, substances or pollutants listed under\nRepublic Act No.6969;<\/p>\n\n\n\n

g)<\/strong> Operate facilities that\ndischarge or allow to seep, willfully or through gross negligence, prohibited\nchemicals, substances or pollutants listed under R. A. No. 6969 into water\nbodies or wherein the same shall be liable to be washed into such surface,\nground, coastal, and marine water;<\/p>\n\n\n\n

h)<\/strong> Undertaking activities\nor development and expansion of projects, or operating wastewater\/sewerage\nfacilities in violation of Presidential Decree. No.1586 and its implementing\nrules, and regulations;<\/p>\n\n\n\n

i)<\/strong> Discharging regulated\nwater pollutants without the valid required discharge permit pursuant to this\nAct or after the permit was revoked for any violation of condition therein;<\/p>\n\n\n\n

j)<\/strong> Non-compliance of the\nLGU with the Water Quality Framework and Management Area Action Plan. In such a\ncase, sanctions shall be imposed on the local government officials concerned;<\/p>\n\n\n\n

k)<\/strong> Refusal to allow entry,\ninspection and monitoring by the Department in accordance with this Act;<\/p>\n\n\n\n

l)<\/strong> Refusal to allow access\nby the Department to relevant reports and records in accordance with this Act;<\/p>\n\n\n\n

m)<\/strong> Refusal or failure to\nsubmit reports whenever required by the Department in accordance with this Act;<\/p>\n\n\n\n

n)<\/strong> Refusal or failure to\ndesignate pollution control officers whenever required by, the Department in\naccordance with this Act; and<\/p>\n\n\n\n

o)<\/strong> Directly using booster\npumps in the distribution system or tampering with the water supply in such a\nway as to alter or impair the water quality.<\/p>\n\n\n\n

The Clean Water Act was passed into law to\nensure that the Philippines will be able to take care of its water resources.<\/p>\n","protected":false},"excerpt":{"rendered":"
